Wesley Snipes had become an unlikely public face for the tax-denier movement, whose members maintain that Americans are not obligated to pay income taxes and that the government extracts taxes from its citizens illegally. The jury clearly understood that in order to convict of fraud, Wesley Snipes had to believe he was breaking the law.
Given the repeated failure of the US Government to show the law obligating wage and salary earners to pay a direct non-apportioned tax, given the US Government's failure to document that the 16th Amendment was actually ratified, given the US Supreme Court has already ruled in Stanton v Baltic Mining that the 16th Amendment did not in fact confer any new taxing authority on the government because it did not explicitly repeal the prior Constitutional prohibition on a direct non-apportioned tax, and most especially, given that the US Government lied us into a war of conquest, the real question is whether a reasonable person looking at all the above information might conclude that there actually is no such law.
If Wesley Snipes, based on the available information, concluded that there is no such law, then there is no criminal intent.
In the end, the government is to blame for the mess. The tax laws are obfuscated to the point where even the IRS help lines have an error rate of 30%. Nobody could find the law in that mess even if it did exist. The government's refusal to document the ratification of the 16th Amendment only fuels suspicion that the government is once again lying to the American people.
The IRS has suffered numerous court defeats in recent years, all of which have been ignored by the mainstream media. It is going to be very hard for the media to ignore Wesley Snipes.
